USAfrica: Nigeria’s Supreme court on Friday July 6, 2012 declared Lady Margery Okadigbo, wife of the former Senate President, late Dr. Chuba Okadigbo as the proper candidate and Senator-elect for the Anambra North Senatorial election of the April 16, 2011.

Okadigbo has been contesting the outcome with Senator Alphonsus Igbeke and Prince John Emeka — her fellow members of the Peoples Democratic Party. In his judgement, Justice M. Muktar, leading three other judges of the appellate court had declared the primary election conducted by Senator Joseph Waku, as the authentic process. It was won by Mrs. Okadigbo.

USAfrica recalls that on December 16, 2011, the Court of Appeal, in Abuja, declared Mrs. Okadigbo winner of the April 16 election.
For the Supreme Court’s ruling delivered by Justice Rodes Vivour: “The Electoral Act is very clear on the powers of the political parties to choose their candidates, and the National Executive Committee of the party conducted the primary that elected the respondent as their candidate.” The apex court ruled that the appellant (Prince John Emeka) did not participate in that primary election. The law, therefore, forbids Emeka from challenging the candidacy of the respondent (Okadigbo).

“The appeal is hereby declared a mere academic exercise and therefore, fails, it is dismissed with no cost.’’

When asked about the challenges and demands of the case, Mrs. Okadigbo told USAfricaonline.com Publisher Chido Nwangwu in May 2012: “I await the ruling of the highest court of the land; and the facts of law, proper process and votes were cast for my candidacy.” Her patience and tasking legal battle have paid off; as she awaits the order for her swearing-in.
